On 29 July 2024, the Supreme Court Panel issued its decision on Salih Mustafa’s request for protection of legality, filed following the issuance of the appeal judgment in his case.

Mr Mustafa raised five grounds in his request for protection of legality, related to the translation of the appeal judgment into Albanian, his conviction for murder as a war crime and in relation to his sentencing.

The Supreme Court Panel granted his request, in part, and annulled the appeal judgment insofar as it relates to Mr Mustafa’s sentence of 22 years of imprisonment. The Supreme Court Panel returned it back to the Appeals Panel in accordance with Rule 194(1)(b) of the Rules to consider reducing his sentence in light of the reasoning set out in the decision of the Supreme Court Panel.
