In its decision filed on 4 February 2022, the Trial Panel in the Mustafa case, having received three expert reports, concluded that the national courts in Kosovo do not provide a realistic avenue for the victims of the crimes charged in this case to claim reparations.  The Panel accordingly decided that, in case of a conviction in the Mustafa case, it will not refer victims to civil litigation in Kosovo courts pursuant to Article 22(9) of the Law and Rule 167 of the Rules, but issue a Reparation Order pursuant to Articles 22(8) and 44(6) of the Law. Furthermore, the Ministry of Justice of Kosovo is ordered to provide the Panel with answers, by 16 March 2022, to a number of questions related to this matter. More details are available in the actual decision.
