Please be informed about the latest matter before the Constitutional Court, which can be seen in this filing. On 22 November 2023, President Trendafilova assigned a Constitutional Court Panel to rule on the referral, filed by the Defence of Nasim Haradinaj, on 21 November. Judges Vidar Stensland, Roumen Nenkov and Romina Incutti will decide on this referral, which was filed confidentially but its public redacted version shall be available within one week.

Protected witness 4280 is the new Shala Defence witness, who is testifying via video-conference link. Please note that this testimony is expected to take place mostly in private session.

Following the completion of the testimony of the 8th Defence witness, the trial in Shala case is adjourned for today. It will resume tomorrow, 28 November, at 09:30 with the testimony of another Defence witness.

Today, 27 November 2023, the Court of Appeals Panel scheduled the pronouncement of the appeal judgment in the Salih Mustafa case for 14 December 2023 at 09:30. Here is the scheduling order.

Following the completion of the testimony of Defence witness Time Kadrijaj, the trial against Shala adjourned for the week. It will resume on Monday, 27 November, at 09:30, when the testimony of another Defence witness is expected to commence.

Defence’s 7th witness Time Kadrijaj resumed her testimony this morning.

Following the SPO’s request in The Specialist Prosecutor v. Hashim Thaçi et al. for modification of the conditions of detention, Trial Panel II has ordered on an interim basis several temporary restrictions on the communications and visits that Hashim Thaçi, Kadri Veseli, and Rexhep Selimi may receive. The Panel has determined that these restrictions are appropriate given the risk of unlawful disclosure of confidential information from the detention facilities. The restrictions will remain temporary until the Panel issues a full decision on the merits of the SPO’s request in due course.
