    Thaçi et al. trial: testimony of a new SPO witness

    The 34th SPO witness in the trial against Thaçi et al. is Dragan Ivanišević. According to the summary read by the SPO in court, the testimony of this witness will be related to his abduction by armed men wearing KLA uniforms in February 1999.

    KSC Weekly Press Briefing on 9 November

    Another KSC weekly press briefing will take place on Thursday, 9 November, at 14:30. During this briefing, the KSC Spokespersons will provide a short update on the latest developments in the judicial proceedings before the KSC, as well as on other public activities of the Court.     Thaçi et al. trial: today’s hearing adjourned

    Following the completion of the testimony of witness Gjergj Dedaj, today’s hearing in the Thaçi et al. trial has adjourned. The trial will resume tomorrow, 9 November 2023, at 09:00, when the testimony of next SPO witness is expected to commence.

    Thaçi et al. trial: oral order on publicity of proceedings

    During today’s hearing, the Panel issued an oral order on the publicity of the proceedings in this case, according to which the parties are ordered to engage into review of the private sessions of the transcripts of hearings within the specific deadlines.

    As a general rule, the parties must further sufficiently identify a protected witness or confidential information in each of their request for redaction of information. In so doing, they should account for the need to ensure the greatest amount of publicity of these proceedings but also the effective protection of those who have been granted protective measures.

    The Panel also introduced an additional measure, which should further foster the publicity of the proceedings: the parties will simultaneously file public redacted versions of the same filings along with their confidential filings, unless there are compelling reasons not to do so.

    Please note that this oral order is related to the same matter we already announced earlier this year, when the Panel expressed its concern that much of the evidence in this trial had been private or closed.

    Isni Kilaj: continued detention ordered

    On 6 November 2023, the KSC Single Judge Nicolas Guillou ordered the continued detention for Isni Kilaj. The decision, which can be seen here, reads, inter alia, that Judge Guillou, having considered the parties’ submissions, found there is a grounded suspicion that Kilaj has committed offences against the administration of justice falling under the KSC jurisdiction and that, due to flight and other risks, continued detention against the suspect is appropriate.
