Thaçi et al. trial adjourned for the week/resumes on 30 September
The trial in the Thaçi et al. case has adjourned for the day and the week. The trial will resume on Monday, 30 September, at 09:00.
Mustafa case: Constitutional Court rejects request by Victims’ Counsel and SPO for extension of time
On 25 September 2024, the Specialist Chamber of the Constitutional Court (SCCC) rejected the request from the Victims’ Counsel and the SPO to extend the deadline for submitting their referrals regarding the decisions on Salih Mustafa's sentence. The SCCC was not satisfied that the two parties have shown good cause that would justify an extension beyond the time limits outlined in Rule 6 of the SCCC Rules.
Thaçi et al. trial: new Prosecution witness in court (91st so far)
After the completion of witness W04422's testimony yesterday, the SPO called their new witness this morning. This witness, with the pseudonym W04669, was, according to the SPO, arrested by certain KLA members in 1999 and then taken to a KLA compound where he was subjected to mistreatment.
Please be reminded that today's hearing will be shorter than usual. There will be a lunch break from 13:00 to 14:00, followed by the last session from 14:00 to 15:00.
KSC Weekly Press Briefing on 26 September
Another KSC weekly press briefing will take place on Thursday, 26 September, at 14:30. During this briefing, the KSC Spokespersons will provide a short update on the latest developments in the judicial proceedings before the KSC, as well as on other public activities of the Court. Single Judge rejected request for variation of Isni Kilaj’s release conditions
In a public version of her decision, filed on 24 September 2024, the Single Judge in the case of Isni Kilaj rejected the Defence request to change the conditions for Isni Kilaj's release, which were set in May this year. The Defence asked for temporary variations of the current conditions to allow him to travel to Albania, but Judge Marjorie Masselot determined that the proposed variations would not sufficiently address the existing risks outlined in Article 41(6)(b) of the Law.
P. Shala case: Trial judgment available in English
A public redacted version of the trial judgment in English, pronounced on 16 July 2024 against Pjetër Shala, is now available in our Public Court Records and on the case page.
Thaçi et al. trial: SPO calls their 90th witness in court
Protected witness W04422 is the new SPO witness, whose testimony began this morning via video-link. The testimony of this witness will take place entirely in closed session.
Januzi et al: Trial preparation conferences from 7-9 October
The Trial Panel in the Januzi, Bahtijari, and Haxhi Shala case has scheduled trial preparation conferences on 7, 8 and 9 October 2024, from 09:30 to 17:30. Additionally, 10 and 11 October are also reserved, with hearings scheduled from 09:30 to 16:00, if necessary. Here is the Panel's decision, which also includes other details like the parties' submissions regarding their investigations, disclosure of evidence, the proposed trial start date of 11 November and witness testimonies.
Constitutional Court Panel assigned to deal with potential referrals re. Mustafa’s sentence
Please be informed about the latest matter before the Constitutional Court regarding the case of Salih Mustafa. President Trendafilova assigned a Constitutional Court Panel on 23 September 2024 to consider the joint request of the Victims’ Counsel and the SPO for an extension of time to submit their referrals, pursuant to Article 49 of the Law. This request follows the Supreme Court's decision on 29 July and the subsequent new sentence for Mustafa by the Court of Appeals Panel on 10 September. Judges Vidar Stensland, Roumen Nenkov, and Romina Incutti will decide on this request and any other related matters in this case.
