Mustafa case: time limit for filing notices of appeal extended

On 9 January 2023, a Court of the Appeals Panel granted in part a motion by Mustafa Defence for an extension of the time limit for filing its notice of appeal against the trial judgment. The Panel authorised the Defence, as well as the SPO, to file their notices of appeal, if any, by 3 February 2023. More details in the decision.

Winter court recess until 6 January 2023

As announced in our Calendar, the winter court recess at the KSC begins on Monday, 19 December 2022 and ends on 6 January 2023. During this period, no hearings are held and some non-essential services are reduced to a minimum. However, the court remains fully functional during this period and work continues across all sections of the KSC. Filings are possible during the recess and, unless otherwise ordered by the judges, judicial deadlines continue running.

Thaçi et al: status conference completed/trial prep. conference scheduled for 18 January

During the status conference in the Thaçi et al. case today, Trial Panel II announced its intention to convene this case for the opening statements on 1 March 2023. The Panel further stated that, in order to achieve this intended starting date, the trial preparation conference will be scheduled for 18 January 2023, followed by the SPO Preparation Conference in early February. The relevant decisions in this respect will follow in due course.

Trial Panel judgment in the Mustafa case

Today, 16 December 2022, Trial Panel I pronounced its Judgment in the case of The Specialist Prosecutor v. Salih Mustafa. The Trial Panel found Mr. Mustafa guilty of the war crimes of arbitrary detention, torture and murder and sentenced him to a prison sentence of 26 years. More details in the Press Release.

Following today’s transmission of the case file by the Pre-Trial Judge, Trial Panel II scheduled a status conference in the Thaci et al. case for 16 December at 10:30. More details in the scheduling order.

KSC Weekly Press Briefing on 16 December

Another KSC weekly press briefing will take place on Friday, 16 December at 11:00. During this briefing, the KSC Spokespersons will provide a short update on the latest developments in the judicial proceedings before the KSC, as well as on other public activities of the Court. Journalists will have the opportunity to ask questions. Pre-registration is required to attend this briefing. To pre-register, please send an email with name and affiliation to [email protected]. Deadline for pre-registration is Friday, 16 December, at 09:00. The Zoom details will be shared following pre-registration. Recordings of the update provided during the Weekly Press Briefings will be made available on the KSC YouTube Channel.

Thaci et al. case: 21 new victims admitted to the proceedings

Pre-Trial Judge Guillou issued a fourth decision on victims' participation in the Thaci et al. case. Twenty one new applicants were admitted to the proceedings as participating victims. They will be included in the existing group of victims (Group 1 with 32 participating victims previously admitted) and shall be represented by the same Victims' Counsel. Twenty applications were rejected. More details in the decision.
