A public redacted version of the Registrar’s submission regarding the implementation of the Reparation Order in the case of Salih Mustafa (filed confidentially on 24 January this year) is now available in our Public Court Records. This submission follows the assignment of a Single Judge on 17 January (see our announcement on this here) to oversee the implementation by the Registrar of the Reparation Order and to receive reports from the Registrar on any actions taken before the Crime Victim Compensation Program in Kosovo.

The Registrar noted that the applicable deadline to submit applications to the Crime Victim Compensation Program on behalf of the victims in this case is within three years from the receipt of the final judgment, as this deadline is stipulated by the amended applicable law in Kosovo. This will be done, in cooperation with Victims’ Counsel, once all relevant information is received and all requirements are met, she said, and specified that, according to the same law, these applications can only be submitted after a determination on Mustafa’s inability to compensate the eight victims himself, fully or in part. If such a determination is requested by the Single Judge, the Registrar stated she can conduct an assessment of Mustafa’s indigence using the system established in the KSC Legal Aid Regulations.

Based on the information provided, the Registrar seeks the Single Judge’s decision on this matter.
