Update on Mustafa’s referral to Constitut. Court: SPO and Victims’ Counsel to provide submissions
On 17 October 2024, the Constitutional Court Panel issued its decision regarding the requests made by the SPO and Victims’ Counsel to file their submissions on Mustafa’s referral, which was submitted on 27 September 2024. The Panel emphasized that the proceedings before the KSC Specialist Chamber of the Constitutional Court only concern alleged violations of an individual’s human rights so there is no inherent right to make submissions or respond to referrals, unless these are necessary for the particular referral. Nevertheless, the Panel found appropriate, on an exceptional basis, to accept submissions from these two parties, with the Victims’ Counsel's submission being limited to the rights of the participating victims. Such submissions are to be filed until 8 November, followed by the response by Mustafa, if any, by 29 November 2024.
